Apps and services provided by Blinix Solutions Private Limited are subject to the following terms.
By using these apps or services, you agree to the following Terms of Use.
These Terms of Use (“Terms”) govern your use of our mobile application (“App”) available on Android and iOS platforms, including any subscriptions or in-app purchases made within the App. Please read these Terms carefully before using the App or making any subscriptions or in-app purchases. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the App or make any subscriptions or in-app purchases.
App Usage and Access
1.1 License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
1.2 Age Restriction: You must be at least 18 years old or the age of majority in your jurisdiction to use the App or make any subscriptions or in-app purchases. If you are under the age of 18, you must obtain the consent of a parent or legal guardian to use the App.
1.3 Account Creation: In order to make subscriptions or in-app purchases, you may be required to create an account within the App. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account.
Subscriptions and In-App Purchases
2.1 Availability: Subscriptions and in-app purchases may be available within the App. These purchases may include, but are not limited to, additional features, virtual items, or access to premium content.
2.2 Payment: You agree to pay all fees or charges associated with the subscriptions or in app purchases made within the App. Payment will be processed through the respective app store (e.g., Google Play Store or Apple App Store) and is subject to their terms and conditions.
2.3 Auto-Renewal: If you make a subscription within the App, it may automatically renew unless you cancel the subscription at least 24 hours before the end of the current subscription period. The app store’s auto-renewal settings and policies may also apply.
2.4 Refunds: Refunds for subscriptions or in-app purchases are subject to the policies of the app store through which the purchase was made. To request a refund please follow the links for Google Play and App Store and follow the steps to see if you are eligible for a refund under the respective App store’s policies. 2.5 Changes to Prices and Features: We reserve the right to modify the prices of subscriptions or in-app purchases, as well as the features offered within the App, at any time without prior notice. Any changes will be effective upon posting within the App.
User Responsibilities
3.1 Compliance: You agree to use the App and make subscriptions or in-app purchases in compliance with all applicable laws and regulations.
3.2 Account Accuracy: You must provide accurate and complete information when creating an account or making a subscription or in-app purchase. You are responsible for updating your account information as necessary to keep it accurate and current.
3.3 Prohibited Activities: You shall not engage in any activities that may disrupt or interfere with the proper functioning of the App, including but not limited to hacking, reverse engineering, or unauthorized distribution of the App.
Intellectual Property
4.1 Ownership: The App and all its content, including but not limited to text, graphics, images, logos, and software are owned or controlled by us or licensed to us and are protected by intellectual property laws.
4.2 Limited Use: You may use the App and its content solely for personal, non-commercial purposes in accordance with these Terms. Any other use, including reproduction, modification, distribution, or sale, is strictly prohibited without prior written consent.
Disclaimer and Limitation of Liability
5.1 No Warranty: The App and its content are provided “as is” without any warranties, express or implied. We do not warrant that the App will be error-free or uninterrupted, or that any defects will be corrected.
5.2 Limitation of Liability: In no event shall we be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the App or any subscriptions or in-app purchases made within the App.
Termination
6.1 Termination by You: You may terminate these Terms by deleting the App and ceasing all use of the App and any subscriptions or in-app purchases.
6.2 Termination by Us: We may terminate these Terms and your access to the App at any time and for any reason without prior notice.
Governing Law and Dispute Resolution
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of laws principles.
7.2 Dispute Resolution: Any disputes arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of Lahore High Court. The arbitration shall take place in Pakistan, and the decision of the arbitrator shall be final and binding.
Miscellaneous
8.1 Entire Agreement: These Terms constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements or understandings.
8.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
Changes to Our Terms
We reserve the right to modify the Terms at any time. We encourage you to review these Terms periodically for any changes. Your continued use of our apps after the updated Terms are posted constitutes your acceptance of the revised terms.
